Sneaker Paradise is an online retail business specialising primarily in sneakers, footwear, branded clothing and related fashion products.

We aim to provide customers with quality products, transparent pricing, secure payment options and reliable delivery.

3. USE OF THIS WEBSITE

You may use this website only for lawful purposes.

You agree not to:

  • use the website for fraudulent or unlawful activities;
  • provide false or misleading information;
  • use another person’s personal or payment information without authorisation;
  • attempt to gain unauthorised access to our website or systems;
  • interfere with the security or operation of the website;
  • introduce viruses, malware or other harmful material;
  • copy or commercially exploit our website content without permission; or
  • use the website in a way that could cause harm to Sneaker Paradise, its customers or third parties.

Sneaker Paradise may restrict or terminate access to the website where reasonably necessary to prevent fraud, abuse, unlawful activity or security threats, subject to applicable law.

4. PRODUCT INFORMATION

We make reasonable efforts to ensure that product descriptions, photographs, prices, colours, sizes and other information displayed on our website are accurate and up to date.

However, minor differences may occur between images displayed on the website and the actual product due to photography, lighting, screen settings or manufacturer variations.

If a product is materially different from its description, defective or otherwise fails to comply with applicable consumer-protection requirements, the customer’s legal rights will apply.

5. PRODUCT AUTHENTICITY

Sneaker Paradise is committed to providing genuine products represented accurately on our website.

Where a product is advertised as belonging to a particular brand, Sneaker Paradise will not intentionally represent a counterfeit product as genuine.

All third-party brand names, trademarks and logos remain the property of their respective owners.

Unless expressly stated otherwise, Sneaker Paradise is not affiliated with, sponsored by or endorsed by the brands whose products are displayed on our website.

6. PRICES

All prices displayed on our website are in South African Rand (ZAR), unless otherwise stated.

The applicable product price will be displayed before the customer completes the order.

Where applicable, delivery charges and other additional costs will be displayed or communicated to the customer before the order is finalised.

Sneaker Paradise reserves the right to change prices and promotional offers at any time.

Such changes will not affect an order that has already been validly accepted, except where permitted by law, including circumstances involving an obvious pricing error or fraudulent activity.

7. SPECIALS AND PROMOTIONS

Promotions and specials may be subject to specific conditions, including:

  • limited quantities;
  • limited promotional periods;
  • selected products or sizes;
  • minimum purchase requirements; or
  • other conditions displayed with the promotion.

Promotional offers may not be exchanged for cash unless expressly stated otherwise.

Where a promotional product becomes unavailable, Sneaker Paradise will communicate with the affected customer and provide an appropriate remedy in accordance with applicable law.

8. PLACING AN ORDER

Customers may place orders through the Sneaker Paradise website by selecting the desired product, size and quantity and completing the checkout process.

Before submitting an order, customers should carefully check:

  • the product selected;
  • size and quantity;
  • delivery address;
  • contact information;
  • price; and
  • payment information.

Customers are responsible for ensuring that the information provided during checkout is accurate.

Sneaker Paradise will provide customers with an opportunity to review and correct information before finalising an electronic transaction, where required by applicable law.

9. ORDER ACCEPTANCE

Submitting an order constitutes an offer by the customer to purchase the selected products.

An automated order confirmation confirms that the order has been received but does not necessarily mean that the order has been finally accepted where payment, stock availability, pricing or other verification is still required.

Sneaker Paradise may decline or cancel an order where permitted by law, including where:

  • the product is unavailable;
  • payment is unsuccessful;
  • fraudulent or suspicious activity is reasonably suspected;
  • there is an obvious pricing or listing error;
  • materially incorrect information has been provided; or
  • fulfilment is otherwise not reasonably possible.

If Sneaker Paradise cancels an order after payment has been received, any refund due will be processed in accordance with applicable law.

10. PAYMENT

Customers must pay using one of the payment methods made available during checkout.

Payments may be processed by third-party payment service providers.

Sneaker Paradise does not ordinarily store customers’ complete card details.

Payment information may be processed by the applicable payment provider in accordance with its security and privacy policies.

An order may only be processed once payment has been successfully authorised or otherwise confirmed.

11. PAYMENT SECURITY AND FRAUD PREVENTION

Sneaker Paradise takes payment security and fraud prevention seriously.

We may conduct reasonable verification procedures where a transaction appears fraudulent, suspicious or otherwise presents a security concern.

Such verification may include reviewing:

  • order information;
  • payment information;
  • customer contact details;
  • delivery information; and
  • previous transaction information.

Sneaker Paradise will never intentionally request your complete banking password, card PIN or online-banking login credentials.

12. DELIVERY

Sneaker Paradise delivers orders to delivery addresses within the areas made available at checkout.

Estimated delivery times will be communicated to customers where applicable.

Delivery times may be affected by circumstances including:

  • courier delays;
  • incorrect delivery information;
  • public holidays;
  • adverse weather;
  • stock availability;
  • operational disruptions; or
  • circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address and contact information.

Where delivery cannot be completed because incorrect or incomplete information was provided by the customer, additional delivery charges may apply where permitted by law.

13. INSPECTION OF PRODUCTS

Customers are encouraged to inspect their order after delivery.

If a product appears damaged, incorrect, defective or materially different from the product ordered, the customer should contact Sneaker Paradise as soon as reasonably possible.

Customers may be asked to provide:

  • the order number;
  • photographs of the product;
  • photographs of the packaging where relevant; and
  • a description of the issue.

Nothing in this section limits any statutory consumer rights.

14. RETURNS, REFUNDS AND EXCHANGES

Sneaker Paradise respects customers’ rights under applicable South African consumer-protection legislation.

Depending on the circumstances, customers may have legal rights to return, repair, replace or obtain a refund for products that are defective, unsafe, not of acceptable quality, materially different from their description or otherwise covered by applicable consumer-protection legislation.

Customers should contact Sneaker Paradise before returning a product so that the appropriate return procedure can be provided.

Returned products may be inspected where reasonably necessary to determine the nature of the issue and the appropriate remedy.

Nothing in these Terms is intended to unlawfully remove, restrict or waive any consumer right.

15. ELECTRONIC TRANSACTION COOLING-OFF RIGHTS

Where applicable, consumers may have a statutory right to cancel certain electronic transactions within the applicable cooling-off period without providing a reason or incurring a penalty, subject to the exceptions provided by law.

The Electronic Communications and Transactions Act 25 of 2002 provides specific cooling-off rights for qualifying electronic transactions. (SAFLII)

Where such a statutory right applies, Sneaker Paradise will process the cancellation and applicable refund in accordance with the law.

16. SIZE EXCHANGES

Customers who require a different size should contact Sneaker Paradise as soon as possible.

Size exchanges may be subject to:

  • availability of the requested size;
  • the condition of the product;
  • original packaging and labels where applicable; and
  • the applicable exchange procedure.

Statutory consumer rights remain unaffected.

17. REFUNDS

Where a customer is entitled to a refund, Sneaker Paradise will process the refund in accordance with applicable law.

Where reasonably possible, refunds will be made using the original payment method.

The time required for a refund to reflect in a customer’s account may depend on the payment provider or financial institution.

18. ORDER CANCELLATIONS

Customers who wish to cancel an order should contact Sneaker Paradise as soon as possible.

If an order has already been dispatched, cancellation may no longer be operationally possible and the customer may instead need to use the applicable return process.

Where a statutory cancellation right applies, that right will not be excluded by these Terms.

19. CHARGEBACKS AND PAYMENT DISPUTES

Customers are encouraged to contact Sneaker Paradise first if they believe there is an issue with an order or payment.

Where a customer initiates a chargeback or payment dispute, Sneaker Paradise may provide the relevant payment provider or financial institution with appropriate supporting information relating to the transaction.

This may include:

  • order information;
  • payment confirmation;
  • delivery information;
  • customer communications;
  • proof of fulfilment; and
  • relevant transaction records.

Nothing in this section prevents a customer from exercising any lawful consumer right.

20. CUSTOMER ACCOUNTS

Where customer accounts are available, customers are responsible for keeping their login information confidential.

Customers should notify Sneaker Paradise if they believe their account has been accessed without authorisation.

Sneaker Paradise may suspend or terminate accounts involved in fraudulent, abusive or unlawful activity, subject to applicable law.

21. PRIVACY AND PERSONAL INFORMATION

Sneaker Paradise respects the privacy of its customers.

Personal information will be processed in accordance with applicable South African privacy legislation, including the Protection of Personal Information Act 4 of 2013 (POPIA).

Personal information may include:

  • name;
  • telephone number;
  • email address;
  • delivery address;
  • billing information;
  • order information;
  • payment-related information;
  • communications with Sneaker Paradise; and
  • information reasonably required for fraud prevention and legal compliance.

Personal information may be used for purposes including:

  • processing orders;
  • processing payments;
  • arranging delivery;
  • communicating with customers;
  • processing returns and refunds;
  • preventing fraud;
  • improving our services;
  • maintaining business records;
  • complying with legal obligations; and
  • sending marketing communications where permitted by law.

Sneaker Paradise will take reasonable measures to protect personal information from unauthorised access, loss, misuse or disclosure.

Customers may request access to or correction of their personal information, subject to applicable law.

A separate Sneaker Paradise Privacy Policy may provide further information regarding our processing of personal information.

22. MARKETING COMMUNICATIONS

Where permitted by law, Sneaker Paradise may communicate with customers regarding products, promotions, specials and business updates.

Customers may unsubscribe from promotional communications where an unsubscribe facility is provided.

Transactional communications, including order confirmations and delivery updates, may still be sent where reasonably necessary to provide services to the customer.

23. THIRD-PARTY SERVICE PROVIDERS

Sneaker Paradise may use third-party service providers to assist with operating the business.

These may include providers responsible for:

  • payment processing;
  • website hosting;
  • e-commerce services;
  • courier and delivery services;
  • communication;
  • analytics;
  • fraud prevention; and
  • marketing.

Where third parties process personal information on behalf of Sneaker Paradise, reasonable measures will be taken to ensure appropriate protection of that information.

24. INTELLECTUAL PROPERTY

Unless otherwise stated, original Sneaker Paradise content appearing on the website, including our:

  • logo;
  • graphics;
  • photographs;
  • original written content;
  • website design; and
  • promotional material

is owned by or licensed to Sneaker Paradise.

Such content may not be copied, reproduced, modified, distributed or commercially exploited without prior permission, except where permitted by law.

Third-party trademarks, logos and brand names remain the property of their respective owners.

25. USER-GENERATED CONTENT

If customers submit reviews, photographs, testimonials or other content to Sneaker Paradise, they confirm that they have the necessary rights to submit such content.

By submitting content, customers permit Sneaker Paradise to use that content for legitimate business, marketing and promotional purposes, subject to applicable law.

Sneaker Paradise may remove content that is unlawful, fraudulent, misleading, abusive, defamatory or otherwise inappropriate.

26. WEBSITE AVAILABILITY

Sneaker Paradise aims to maintain a reliable website but does not guarantee that the website will always be available or completely error-free.

Temporary interruptions may occur because of:

  • maintenance;
  • technical problems;
  • software updates;
  • hosting problems;
  • security incidents; or
  • circumstances outside our reasonable control.

27. EXTERNAL WEBSITES

Our website may contain links to third-party websites or services.

Sneaker Paradise is not responsible for the content, availability, security or privacy practices of third-party websites.

Customers should review the applicable terms and privacy policies of third-party websites before using them.

28. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited under South African law.

Subject to applicable law, Sneaker Paradise will not be responsible for losses caused by circumstances outside our reasonable control, including third-party courier delays, payment-provider outages, internet disruptions or other events beyond our reasonable control.

Nothing in this clause removes or restricts statutory consumer rights.

29. FORCE MAJEURE

Sneaker Paradise will not be responsible for delays or failure to perform an obligation where such delay or failure results from circumstances beyond our reasonable control.

Such circumstances may include:

  • natural disasters;
  • severe weather;
  • strikes;
  • civil unrest;
  • government restrictions;
  • power outages;
  • telecommunications failures;
  • courier disruptions;
  • payment-system failures;
  • cyber incidents; or
  • other circumstances beyond reasonable control.

Sneaker Paradise will take reasonable steps to minimise the impact of such circumstances.

30. COMPLAINTS

Customers who have a complaint should first contact Sneaker Paradise so that we can attempt to resolve the matter directly.

Complaints should include:

  • the customer’s name;
  • order number, where applicable;
  • contact details;
  • description of the complaint; and
  • relevant supporting information or photographs.

Sneaker Paradise will review complaints fairly and communicate with the customer regarding the proposed resolution.

31. DISPUTE RESOLUTION

Sneaker Paradise encourages customers to resolve disputes directly with us wherever reasonably possible.

Nothing in these Terms prevents a customer from exercising any right available under South African law or approaching a competent regulatory or dispute-resolution body.

Where an applicable industry ombud, accredited alternative-dispute-resolution scheme or other competent authority has jurisdiction, the customer may use the applicable process.

32. GOVERNING LAW

These Terms are governed by the laws of the Republic of South Africa.

Any dispute concerning these Terms or the use of the Sneaker Paradise website will be dealt with in accordance with applicable South African law.

Nothing in these Terms prevents a customer from exercising any mandatory statutory right.

33. CHANGES TO THESE TERMS

Sneaker Paradise may update these Terms from time to time to reflect changes to:

  • our business;
  • products and services;
  • payment methods;
  • delivery arrangements;
  • legal requirements; or
  • website functionality.

The latest version will be published on the website together with the applicable effective date.

Changes will not retrospectively remove rights that a customer has already acquired under applicable law.

34. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or amended to the minimum extent necessary to make it lawful and enforceable where possible.

If this is not possible, the affected provision will be severed without affecting the validity of the remaining provisions.

35. ENTIRE AGREEMENT

These Terms, together with the Sneaker Paradise Privacy Policy, Returns & Refund Policy, Shipping & Delivery Policy and any other policies expressly incorporated into the website, constitute the terms applicable to the customer’s use of the website and purchases from Sneaker Paradise.
